Terms of Service
Welcome to the 7FMall platform. Please read these terms and conditions carefully. The following
terms of use govern your use of and access to the platform, and by accessing the platform and using the
services, you agree to be bound by these terms. If you do not agree to these terms of use, do not access or use
the platform services.
Access to and use of the platform’s password-protected, secure areas, and use of services is limited to
customers who have an account. You must not gain unauthorized access to any other protected information.
If you are a minor: You must obtain the consent of your parent or legal guardian who accepts these Terms of Use
and agrees to be responsible for: (i) your conduct; (ii) your use of any Services or purchases of products any
fees; (iii) you accept and abide by these Terms of Use. If you do not have the consent of your parent or legal
guardian, you must stop using and accessing the services of this platform.
- Definition and Interpretation
Unless otherwise defined, the definitions and provisions for interpretation in Schedule 1 shall apply to these
Terms of Use. - General Use and Access to The Services
2.1 Platform Services Usage Guidelines
You agree to abide by any guidelines, notices, operating rules and policy instructions related to the use of the
Services or access to the Platform, as well as any revisions to the foregoing that we may issue from time to
time. We reserve the right to revise these guidelines, notices, operating rules and policy descriptions at any
time, and you are deemed to be aware of and bound by any of the above changes by posting them on the platform.
2.2 Restricted Activities
You agree and undertake the following:
(a) impersonate any person or entity, falsely state, or otherwise misrepresent your affiliation with any person
or entity;
(b) use the Platform for illegal purposes;
(c) attempt to gain unauthorized access or otherwise disrupt other computer networks connected to the Platform;
(d) post, advertise or transmit any Prohibited Material through the Platform;
(e) interfere with others’ use and enjoyment of platform services;
(f) use or upload in any way viruses, destructive components, malicious code or harmful components that may
damage data;
2.3 Availability of the Platform and Services
We may upgrade, modify, suspend the provision of all or part of our Services without giving any reason or prior
notice, and we are not responsible for such modifications.
2.4 The right, but not the obligation, to monitor content
We reserve the right, but have no obligation:
(a) monitor, screen or otherwise control any activity, content or material on the Platform. We may, in our sole
discretion, investigate any breach of the Terms and may take appropriate action;
(b) block or restrict any Customer’s access to the Platform;
(c) ask you to provide any information and data relating to your access to the Platform at any time, and where
you refuse to disclose such information, we have reasonable grounds to suspect that you have provided
inaccurate, misleading or fraudulent information and data.
2.5 Privacy Policy
Your use of the Services and access to the Platform is also governed by the Privacy Policy set forth herein.
2.6 Terms and Conditions of Sale
The purchase of any product is subject to the terms and conditions of sale.
2.7 Anti-Money Laundering and Regulatory Compliance
You acknowledge and agree that the Platform is committed to complying with all applicable anti-money laundering
(AML), counter-terrorist financing (CTF), and market conduct laws and regulations. Accordingly, you hereby
represent, warrant, and undertake that:
(a) you will not use the Platform or any Services to engage in, facilitate, or promote any activity that may
constitute money laundering, terrorist financing, fraud, market manipulation, insider trading, or any other
illegal or abusive trading practice;
(b) all funds or assets you deposit, transfer, or otherwise use in connection with the Platform derive from
legitimate sources and are not the proceeds of any criminal or unlawful activity;
(c) you will not structure or attempt to structure any transaction to avoid reporting thresholds or regulatory
scrutiny;
(d) you will provide, upon request, any information or documentation that the Platform reasonably deems
necessary to verify your identity, source of funds, or the nature of any transaction, including but not limited
to government-issued identification, proof of address, bank statements, or source of wealth declarations;
(e) you acknowledge that the Platform reserves the right to monitor, review, and analyze your transactions and
trading activities for the purpose of detecting suspicious patterns, market abuse, or potential violations of
applicable laws. Such monitoring may be conducted manually, through automated systems, or through third-party
service providers;
(f) if the Platform, in its sole discretion, suspects or determines that any transaction or activity may involve
money laundering, terrorist financing, market manipulation, or any other violation of applicable laws or these
Terms, the Platform shall have the right to:
(i) delay, reject, block, reverse, or cancel any transaction;
(ii) freeze or restrict access to your account or any funds therein;
(iii) suspend or terminate your access to the Services without prior notice;
(iv) report such activity to the relevant regulatory or law enforcement authorities, as required or permitted
by law; and
(v) disclose your account information and transaction details to such authorities;
(g) you agree that you shall not be entitled to any compensation, damages, or claims arising from any action
taken by the Platform under this Section 2.7, provided that such action is taken in good faith and in compliance
with applicable legal obligations;
(h) the Platform may revise its AML/CTF and market surveillance policies from time to time, and any such
revisions shall be effective upon posting on the Platform. Your continued use of the Services constitutes your
acceptance of those revisions.
- Use of the Services
3.1 Application of these Terms
In addition to all other terms of these Terms of Use, the provisions in this Section 3 are additional specific
terms governing your use of the Services.
3.2 Restrictions
Use of the Services is limited to authorized customers of legal age and legal capacity. Customers who are in
breach of these terms and customers who are temporarily temporarily using any of the Services may not use the
Services even if they meet the requirements of this Section 3.2.
3.3 General Terms of Use
You agree to:
(a) always access and use the Services only for lawful purposes and in a lawful manner, and further agree to
conduct any activity related to the Services;
(b) ensure that the relevant information or data you post or cause to appear on the Platform is accurate and
agree to be solely responsible for such information and data.
3.4 Product Descriptions
While we endeavour to provide accurate descriptions of products, we do not warrant that such descriptions are
accurate, current or error-free.
3.5 Product Prices
We reserve the right to revise the listed prices at any time without giving any reason or prior notice.
- Customers with 7FMall Account
4.1 Username and Password
If you need to use our platform and services, you need to create an account and provide personal data. Usernames
and passwords may be: (i) determined by us and issued to you; or (ii) provided by you and accepted by us at our
sole discretion. We may require you to update your personal data at any time in our sole discretion without
giving any reason or prior notice and shall not be responsible or liable for any loss arising from the following
reasons. You hereby agree to keep your username and password confidential, to be responsible for the security of
your account, and not to disclose or use your username and password. If you have reason to suspect that the
confidentiality of your username and password has been compromised, or that your username and password have been
subjected to any unauthorized use, or that your personal data needs to be updated, you should notify us
immediately.
4.2 Claimed Use and Access
You agree and acknowledge that any use of the Services and any access to the Platform shall be deemed to be as
the case may be:
(a) your access to the relevant platform or use of the service;
(b) information, data or communications that you post, transmit and effectively post;
- Limitation of Our Liability and Obligations
5.1 Make No Representations or Warranties
All data and information contained in the Platform are for informational purposes only. All representations or
warranties of any kind, implied, express or statutory, including warranties of non-infringement of third party
rights, title, and merchantability. Without prejudice to the generality of the above, we do not guarantee that:
(a) the accuracy, timeliness, adequacy, commercial value or completeness of all data and information contained
in the Platform;
(b) any identified deficiencies will be corrected;
(c) the Platform is free of any computer virus or other destructive code, agent, program or macro;
5.2 Disclaimer of Liability
7FMall shall not be liable to you for any loss directly or indirectly caused by:
(a) any access, use or inability to use the Platform and Services;
(b) rely on any data or information provided through the Platform;
(c) any system, server or connection failure;
5.3 At Your Own Risk
Any misunderstandings, errors, damages, costs or losses arising from the use of the Platform are entirely at
your own risk and we shall not be liable.
- Hyperlinks and Alerts
6.1 Hyperlinks
As a convenience, we may include hyperlinks to third-party websites. Such linked sites or content are not under
our control and we are not responsible for any errors, omissions, delays, defamation, falsehoods, obscenity,
pornography, profanity contained in the content. Hyperlinks to any other websites do not imply endorsement or
verification of such websites, and you agree that access to or use of such linked websites is entirely at your
own risk.
6.2 Promotions
We may attach banners, Java applets to the Platform to promote our products and services. For the avoidance of
doubt, you are not entitled to receive payment, fees or commissions for any such promotional information.
- Your Submissions and Information
7.1 Your Submissions
You authorize us to use the information you submit to the Platform, including but not limited to questions,
comments and suggestions (collectively, “Submissions”). When you post comments to the Platform, you also grant
us the right to use the username you submit in such comments or other content. You may not use false email
addresses, impersonate others, or otherwise mislead us. We may, but are not obligated to publish, delete or edit
your Submission.
7.2 Consent to receive emails
You fully, freely and expressly authorize us to collect, process and use any information (including personal
data) you provide for the purpose of sending informational and promotional emails. Your agreement to the
provisions of this Section 7.2 constitutes your agreement to the provisions of any spam control laws. You may
subsequently opt out of receiving promotional emails by clicking on the appropriate hyperlink in any promotional
email.
7.3 Government agencies may from time to time require 7FMall to disclose certain information in connection with
any audit or investigation. You understand that we do not need to contest any request made by the (government)
authorities.
- Termination
8.1 Termination by Us
We may immediately terminate your use of the Platform or disable your username and password at our sole
discretion. We may prohibit you from accessing the Platform for any reason, including for breach of any of these
Terms of Use, or if we believe that you have violated or acted in a manner inconsistent with any of the Terms,
or if we believe or any regulatory authority believes that it is inappropriate to continue to provide you with
Platform-related information Serve.
8.2 Your Termination
You may terminate these Terms of Use by giving us 7 days’ written notice.
- Notice
9.1 Our Notices
All notices or other communications to you if:
(a) dissemination via any electronic media we may choose will be deemed to notify you on the date of
publication;
(b) sent by post to your address will be deemed to be received by you the day after such post.
9.2 Your Notices
You may only send notices to us in writing, to the email address designated by us, and we will only be deemed to
have received such notices upon receipt of such notices. While we strive to respond to your notices in a timely
manner, we cannot guarantee that we will always respond at a consistent rate.
9.3 Other Means
Notwithstanding clauses 9.1 and 9.2, we may from time to time specify other acceptable means (including but not
limited to email or other forms of electronic communication).
- General
10.1 Cumulative Rights and Remedies
Unless otherwise provided in these Terms of Use, the provisions of these Terms of Use and our rights and
remedies under these Terms of Use are cumulative and do not affect any rights we may have under these Terms of
Use. rights or remedies.
10.2 No Waiver
Our failure to enforce these Terms of Use does not constitute a waiver of these Terms, and this does not affect
our right to enforce these Terms of Use in the future. We remain entitled to our rights and remedies in any
other case of your breach of these Terms of Use.
10.3 Amendments
We may change these Terms of Use by notice on the Platform or by such other means of notice as we designate
(which may include notice by email), such changes taking effect on the date we designate through the means
above. If you use the Platform or Services after that date, you are deemed to have accepted the change. If you
do not accept the changes, you must stop accessing or using the Platform and Services and terminate these Terms
of Use.
10.4 Correction of Errors
Any typographical, clerical or other errors or omissions in any of our acceptances, invoices or other documents
shall be corrected without liability on our part.
10.5 Language
If these Terms of Use are executed or translated in any language other than English (“Foreign Language
Version”), the English language version of these Terms of Use shall prevail over the foreign language version.
10.6 Binding and Conclusive
You acknowledge and agree that any records relating to the Platform and the Services shall be binding and
conclusive. You hereby agree that all such records may be used in evidence.
